Terms of Use

1. Acceptance of Service

Accessing or using PadelCortex (hereinafter the "Service") constitutes your full and unreserved acceptance of these Terms of Use. If you do not agree with any of the conditions set out herein, you must refrain from using the Service.

These terms apply both to the administrator who creates and manages tournaments (hereinafter the "Organising Admin") and to players who participate through the registration forms generated by that administrator.

2. Description of the Service

PadelCortex is a Software as a Service (SaaS) platform designed to facilitate the organisation and management of padel tournaments. Its features include:

  • Creation and configuration of tournaments with multiple categories.
  • Collection of participants' time availability.
  • Automatic generation of competition draws and match schedules.
  • Recording of results and calculation of standings and ELO rankings.
  • Sending email notifications to participants.
  • Generation of public registration links and results pages.

3. Organising Admin Obligations

The Organising Admin agrees to:

  • Provide accurate information about the tournament (venue, dates, categories and participation conditions).
  • Inform players about the processing of their data in accordance with PadelCortex's Privacy Policy before sharing the registration link.
  • Not use the Service for unlawful, fraudulent or bad-faith activities.
  • Keep their access credentials secure and not share them with unauthorised third parties.
  • Notify PadelCortex immediately of any unauthorised use of their account.

4. Player Obligations

A player completing the registration form agrees to:

  • Provide accurate and up-to-date data (name, email address and availability).
  • Not provide false information or impersonate another person.
  • Not use the registration form for any purpose other than participating in the tournament.
  • Not send unsolicited communications (spam) to other participants through the channels provided by the Service.

5. Intellectual Property

All source code, visual design, logos, scheduling algorithms, ELO calculation logic and other elements comprising PadelCortex are the exclusive property of its developers and are protected by applicable intellectual and industrial property legislation.

Use of the Service does not grant the user any intellectual property rights over the software or its components. Reproduction, modification, distribution or reverse engineering of the Service without prior written authorisation is expressly prohibited.

6. Limitation of Liability

PadelCortex is provided "as is" and "as available". To the maximum extent permitted by applicable law:

  • PadelCortex does not warrant that the Service will be free of errors, interruptions or security vulnerabilities.
  • PadelCortex shall not be liable for any direct, indirect, incidental or consequential damages arising from the use or inability to use the Service, including loss of data or revenue.
  • PadelCortex's maximum liability to the Organising Admin shall not exceed the amount paid for use of the Service in the three months preceding the event giving rise to the claim.

7. Pricing and Payment

Access to PadelCortex is governed by the model described on the pricing page (/pricing), in summary:

  • The first tournament created by an Organising Admin is free.
  • From the second tournament onwards, a fee of EUR 1 per registered player applies, calculated at registration close. This amount is due before the draws are published and can be invoiced to the club or the organiser personally.
  • Acceptance of the model is explicitly required on the second-tournament creation form (paywall acceptance checkbox).

Amounts are expressed exclusive of VAT unless otherwise stated. If additional plans (Club, Circuit) or payment gateways (Stripe) are added in the future, they will be communicated in advance and require explicit acceptance.

8. Right of Withdrawal (Consumers)

If you subscribe to the Service as a consumer resident in the European Union, you have 14 calendar days from sign-up to withdraw from the contract without giving any reason, under Article 102 of Spanish Royal Legislative Decree 1/2007 (General Law for the Defence of Consumers and Users).

Exceptions: by requesting the creation of a tournament and closing its registration, you expressly request immediate performance of the Service and acknowledge that the right of withdrawal is lost once the Service has been fully performed (Art. 103.a RDL 1/2007).

To exercise the right of withdrawal, send an email to info@padelcortex.app stating your name, admin email and affected tournament. Where applicable, amounts paid will be refunded within 14 calendar days using the same payment method.

9. Modifications to the Service and Terms

PadelCortex reserves the right to modify, suspend or discontinue the Service at any time, with or without notice, for technical, operational or business reasons.

PadelCortex may also update these Terms of Use. Material changes will be communicated at least 15 days in advance via the registered email address or through a prominent notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of those changes.

10. Jurisdiction and Governing Law

These Terms of Use are governed by Spanish law.

For the resolution of any dispute, the parties submit to the courts and tribunals of Madrid, Spain, expressly waiving any other jurisdiction. This clause shall not be enforceable against a consumer: if you are a consumer resident in Spain or the European Union, you may bring proceedings before the courts of your domicile under Article 90.2 of RDL 1/2007 and Regulation (EU) 1215/2012.

Additionally, as a consumer resident in the European Union you may use the European Commission's online dispute resolution platform (https://ec.europa.eu/consumers/odr).
